Raila's invitation to Kibaki for a live debate may be an acceptable democratic gesture but anyone who thought Kibaki would oblidge (including Raila himself) would have been engaging in wishful thinking.

With the trouble Kibaki encounters just to come up with a sensible statement 'off the cuff' during public rallies, it would have been hell for hioms should he have allowed himself come under impromptu attacks from journalists and the public.

Whatever reasons he gave, i would say his strategists were wise to reject the call since it would have done a lot of damage to his campaigns.

Well, after the much hyped HIV testing week begun, i challenged myself for the test and slowly headed to the center located at St. Pauls University Chapel.

The counselling went on well (infact, it felt like i was the one counselling the counsellor). When blood was drawn from my finger and put in the testing kits, tension filled the air as silence engulfed the room. After what seemed like an eternity, the results were out and as i expected, they were negative.

The tension should not in any way be taken to mean that i wasnt sure about my status, but even the surest of them all will be wondering what result may be recorded in the test, its probably the toughest moment of the whole period.
People in this country are willing to sacrifise lives of other human beings for the sole purpose of winning a general election.

The usual denials followed from the minister but any sane Kenyan does not need to be told that the weapons were his baggage being transpoted in his car by his driver and staff members. He is guilty.

BUT STILL, THERE ARE CHANNELS WHICH CAN BE USED TO ADDRESS THESE ISSUES. WE HAVE A MEDIA COUNCIL THAT CAN DEAL WITH DISCIPLINARY CASES AGAINST JOURNALISTS. WE HAVE COURTS WHICH CAN DECIDE ON SUCH ISSUES. THE GOVERNMENT SHOULDN HAVE GONE THAT WAY.
IN THE LIST OF COUNTRIES WHICH HAVE THE LEAST MEDIA FREEDOM, CHINA IS AMONG THE TOP TEN. iT WILL BE SCARY TO NOTE THAT THIS IS THE WAY THAT CHINA ACTUALLY BEGUN. THEIR MEDIA IS NOT FREE.

THIS IS HOW AND WHY MWIRARIA RESIGNED

Mwiraria did not resign specifically because of the pressure of Anglo-Leasing, a senior goverment official in the VP office has confirmed.

Friday, last week the United States goverment wrote to the Prezzy and copied the letter to Mwiraria warning that unless the Finance minister resigned or was sacked the US would not grant him a Visa to attend a high profile donors meeting (IMF and World Bank)in Washington DC.

Monday morning the letters were delivered. Tuesday evening after the World bank underlined their pressure to withold money and not deal with Mwiraria President kibaki and his men sense the seriousness of the issue, so Kibaki summons them to State house for an evening meeting.

the meeting discussed among other things options out for Mwiraria, but it was agreed he had to leave the treasury to avoid embarassment by the US goverment via a publicly cpommunicated Visa denial.

Tuesday no conclusions, so Wednesday morning, Kiraitu, Mwiraria the VP na dMuthaura gather at State House again, and the option of a minor cabinet reshuffle is considered but that too was dismissed as a poor strategy.

Mutahi Ngunyi, who has been a key advisor of the government since leaving the nation is summoned for his intriguing options and he suggests the sacrifice principle, quoting an incident when Moi had to sack Biwott and even jail him over the Ouko report to cool down tempers and then release him and make him a powerful minister after the public had forgotten. Everyone in attendance agrees, but questions emerge over repurcussions of the resignation to the rest who are caugt up in the Anglo-Leasing issue.

At that point the Mutahi says that they should follow up the resignation with the release of the goldenberg report, which just happened this morning.

With that a call is made to DP headquarters to have a press conference at 12.00pm demanding the resignation of Mwiraria, at 1: 30 after the lunchtime news the press release circulates that Mwiraria has a press Conference....then the guy resigns, more out of donor pressure, a visa hitch embarassment scenario rather than to pave way for investigations.

The rest are to stay put to the end.the meeting agrees.no speeches on the matter. However Thursday morning, the VP is summoned to State House again this time for a brief that he has to defend himself, stare at the Camera's and argue that Immigration department has a new minister so you cannot interfere with investigations, cancel the cabinet meeting earlier called by Muthaura to ensure the divisions on Anglo-Leasing do not permeate the level till it sorted out.

ANd that is why Mwiraria quit, like the lamb that was sacrificed to enable the exodus passover..so was Mwiraria..

READ A SECTION OF GITHONGO'S DOSSIER TO KIBAKI. ITS HERE.

Excerpts from Githongo's dossier to Kibaki

"I called Vice-President Moody Awori on the hotline regarding the Immigration Department contract matters and he denied knowledge of this, saying that he had made a point of not knowing about these things. However, he promised that he 'would look into the matter'

"On March 27 and 28 2004, during a conference on money laundering conference in Mombasa, Finance minister David Mwiraria pulled me aside during the break
and said Hon (Chris) Murungaru had called him. Apparently Murungaru had asked him whether he had authorized an investigation into the bank accounts
of an individual named Anura Perera at Equatorial Bank."

"Mwiraria informed me that Perera "was a strong supporter of the President and had backed him for over 10 years and had even paid the President's medical bills following his road accident in 2002".

"Head of Banking Fraud Department of the Central Bank, Nicholas Kamwende, confirmed that indeed he was conducting such an investigation because his
department suspected Equatorial Bank was involved in the setting up of fictitious accounts that were 'being used for capital flight'.

May 2, 2004
"At the end of April 2004, I travelled to the UK with Hon. Kiraitu Murungi to the offices of Kroll Associates. While at Kroll we asked to do a search
for the company called Anglo Leasing and Finance Company and found that no such entity existed in the UK or had ever existed there. Upon returning to Kenya, I found the investigations were proceeding expeditiously despite hiccups, and Your Excellency, I updated you on the progress including the fact that senior officials in the government were possibly implicated in the unfolding saga.

Those mentioned by the investigators at this stage included Hon. Moody Awori, Hon. David Mwiraria, Hon.Chris Murungaru, PS Home Affairs Mr Sylvester Mwaliko, PS Internal Security Mr David Mwangi, Mr Alfred Getonga, Mr Deepak Kamani and Mr Jimmy Wanjigi.

On May 4, 2004, I was invited by Kiraitu Murungi to a meeting over lunch at Vice President Moody Awori's House in Lavington. Minister Chris Murungaru was also present during the meeting. All three ministers queried the need for a probe. "The KACC investigations revealed that everything pointed to gigantic attempted fraud." In fact, they revealed that an additional Sh300 million (3,750,000 Euros) was being processed for payment to Anglo Leasing. However, on the same day, Murungaru announced the cancellation of the project.

On May 13, KACC and the Controller and Auditor General released conclusive reports implicating Magari, Mwaliko and Sitonik. Head of Civil Service Francis Muthaura later asked him to find out who Anglo Leasing were through a French firm, FCOF, that had placed advertisements in the Press defending the integrity of the firm. The adverts had been placed by a prominent Nairobi lawyer, Mr Fred Ojiambo.

On May 14, 2004, Githongo handed over to Kibaki the final report on the Anglo Leasing matter and advised that a similar project was underway at the Police Dept connected with the construction of a forensic lab for the CID. (Central Bank sent over transmission sheet that showed that AL, from their back account as Schroder Co Bank AG in Zurich had 'refunded' 956,700 euros on 14-05-04. The transaction was certified on 17-05-04 by the central bank)

May 17, 2004
"In the afternoon of the same day Hon. Kiraitu Murungi stepped into my office unannounced. He expressed concern about the way the AL investigation was going. He told me 'people' were concerned whether I appreciated the political costs of my work. He told me that it was hoped once the AL paid back the money the investigation would stop. Hon. Mwiraria dropped in on me in the same afternoon. He warned that Mr Jimmy Wanjigi had sworn to kill me; and just as Kiraitu had suggested earlier, he expressed the hope that the Immigration investigation would stop since the money had now been paid back. He expressed concern that he'd heard I was 'investigating' him, Hon. Murungaru and even Brig. Boinett.

May 24, 2004
"After my meeting with the Public Accounts Committee (PAC), I visited a senior politician who had been seeking for us to have a chat. I was aware that he was in close contact with both Hon. Murungi and Hon. Murungaru and had calculated that being a friend of my father he may communicate to me messages that perhaps the two leaders may have wanted to emphasise to me. His advice to me was to be particularly careful because there was no way senior ministers were not involved in the Anglo Leasing matter. He emphasised repeatedly that my security was now an issue and he hoped I could take more of a back seat in the Anglo Leasing investigation. He also warned me quite logically that if the stability of the regime was threatened by my work then the President would stop backing me. He sincerely commiserated with me regarding my dilemma - that of finding that the President's close associates were deeply involved in the corruption that has been uncovered within our administration. He told me that Alfie Getonga was going around complaining openly about my work; Hon Kiraitu was accusing me of working for foreigners and Murungaru was threatening my life directly. Your Excellency, on that night I briefed you on how the PAC session has gone and the fact that Hon Kiraitu indicated to me that in every likelihood, Hon Murungaru and Alfred Gitonga were behind the Anglo Leasing matter.
With the opponent waiting for a fallout among those people, hey may realise too late that they were not even thinking of going separate ways.

I have a feeling that all these guys, Uhuru, Ruto, Raila, Mudavadi and others are just confusing the government and will all support Kalonzo come 2007.
The Kalonzo foundation seems to be a starting point towards that end.

I have this close friend of mine who helps out with the red cross relief effort in North Eastern Kenya. He tells me that they are feeding goats there, not people.

The staple food for cushited happens to be whety meals i.e. chapati, spaghetti, pasta and rice. Since they have livestock, they do consume meat and milk alot. All they need is wheat and water. He says the best thing you can do to them is give them water for their animals and they will do the rest themselves.

Its not strange, so, finding these guys crashing the relief maize and feed it to their goats as they go hungry. Give them what they can use.

Kenya Referendum: Verdict on the Draft Constitution.

With the completion of the much awaited referendum process, it is time for Kenyans to sit back and reflect on the tides and turns that the process has gone through, examine the effect of their decision to reject the draft and, in consultation with their leaders, chant their way forward towards the realization of their dream to have a new people driven constitution for the country, written by the people themselves.

The journey has fore sure been long and rough. As a result of the misrule that governed the country for many years, Kenyans cried fowl and demanded that the constitution be amended. Their dream was to have a president who had limited power and proper checks were to be put in place to realize this. The clamor was not just to check the presidency. They demanded a constitution that distributed resources equally to all parts of the country, that protected ownership of land, that provided for their basic human rights, one that guaranteed women a position in the society. All Kenyans wanted was a constitution for the people, and more, one done by the people themselves.

The sitting government gave in and initiated the people driven process of rewriting the constitution. Views were collected from all and sundry. The young and old, educated and illiterate, sick and healthy, those in the country and abroad, all were given the opportunity to state what they wanted in their constitution. Views which were put together by constitutional experts and brought forward for discussion by a smaller conference that constituted people from all corners of the country. This is where hell broke loose and politicians came in. Two camps emerged, one for the ruling elite and the other for the opposition.

The ruling elite camp supported a government system which had a powerful president arguing that many centers of power were a recipe of civil war. They wanted the government to control all the national resources and be responsible for all the finances generated from all sectors of the country’s economy.

Their view was not taken kindly by the opposition. They vouched for the exact opposite. A ceremonial president with a very powerful parliamentary system led by a prime minister who will automatically be the leader of the majority party in parliament. They wanted resources devolved down to where they were generated to help the local communities. They argued that when resources were distributed from the national arena, only those in good books with the ruling elite carry the day and reap the most benefits. This view, coincidentally, was held by the majority of Kenyans (or they must have read the mood of the people).

The tug of war then ensued. Members from both camps initially engaged in consensus talks that yielded no fruit. They turned to blackmail and insults. Those in government threatened their colleagues with different views of dire consequences. There was shifting of alliances from micro factions in parliament. Claims of bribes to members of parliament filled the air. The war was fuelled by the announcement of the date for the referendum by the Electoral Commission of Kenya. Members of parliament swung into full campaign action totally overshadowing the civic education process that was supposed to enlighten Kenyans on the contents of the draft constitution that they were putting to vote during the referendum. Both camps interpreted the document in a manner that suited their views leading to a lot of propaganda talk. Even the vice president was quoted saying that voting down the draft constitution meant ‘no confidence’ with the president hereby taking issues completely put of context.

Finally, the day came. November 21st, 2005 was the day that Kenyans went out to decide. They came out in their large numbers and peacefully cast their ballot. As I write this article, I am proud being Kenyan. I went out and cast my own vote and as prophets of doom predicted, there was absolutely no violence. Kenyans conducted themselves in levels of maturity that are characteristics of very stable democracies. We have set a very high standard for other African countries, standards which my take ages for them to reach.

And the verdict was clear, Kenyans rejected the draft constitution with a convincing margin. With voter a turnout of slightly over 55%, 60% of them rejected the draft, sealing the process that had cost the country over Kshs 5 Billion ($65 Million). Talking to a section of Kenyans, they don’t regret the position they took and feel that the money lost in the process is no match for the loss that would have sufficed had the draft constitution been passed.

That is their verdict.
